WAIVER AND RELEASE FORM RELEASE OF LIABILITY
In return for being allowed to participate in the WWF Canada fundraiser, volunteer activities and all related activities, including any activities incidental to such participation (“Volunteer Activities”), the undersigned Volunteer or Parent/Legal Guardian of Volunteer if Volunteer is under the age of majority in their province (hereafter referred to using “I”, “me”, or “my”) releases and agrees to release and forever discharge World Wildlife Fund Canada, its officers, directors, employees, sub-contractors, sponsors, donors, agents, legal representatives, affiliates and their respective directors, officers, employees and agents (collectively “WWF Canada”) from any and all claims, actions, suits, proceedings, demands, damages, and liabilities whatsoever (collectively the “Claims”) for death, personal injury, damage or loss to property and any and all other loss or injury, including, without limitation, economic loss or consequential damages (collectively “Damages”) that may result, directly or indirectly, from my or the minor child’s participation in the Volunteer Activities, activities related to and/or activities in preparation for the Volunteer Activities. This release applies regardless of whether the Damages are occasioned, wholly or in part, by any act or omission of one or more of the organizers or Representatives, whether negligent or grossly negligent or otherwise. This includes all present and future claims, actions, liabilities, costs, expenses and demands that may be made by me, my family, estate, heirs, or assigns for property damage, personal injury, or wrongful death arising as a result of my participation in the Volunteer Activities wherever, whenever, or however the same may occur.
I undertake to closely supervise all children/dependents who are under the age of majority at the date of event, and ii) are accompanying me on the event. I agree to take complete responsibility for his/her/their action(s), safety and well-being during the Volunteer Activities. I completely waive all rights to any claims and liabilities against the organizer and/or WWF-Canada with respect to any injury caused to such minor children/dependents while being at the Volunteer Activities.
I understand and agree that the WWF Canada is not responsible for any injury or property damage arising out of the Volunteer Activities, even if caused by their ordinary negligence or otherwise.
I understand that participation in the Volunteer Activities involves certain risks, including, but not limited to, possible serious injury and death. I am voluntarily participating in the Volunteer Activities with knowledge of the dangers involved and I agree to accept all risks of participation.
I also agree to indemnify and hold harmless the WWF Canada for all claims arising out of my participation in the Volunteer Activities. I further agree that the organizer(s) and/or WWF-Canada may be required to share my personal details (including first and last name as well as my telephone phone number) to any competent authority in case of a security event and I fully consent to any such required disclosure if ever necessitated.
I understand that this document is intended to be as broad and inclusive as permitted by the laws of the province in which the Volunteer Activities take place and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect.
I represent that, to my knowledge, I am in good health and suffer no physical impairment that would or should prevent my participation in Volunteer Activities.
I also understand that this document is a contract which grants certain rights to and eliminates the liability of the WWF Canada.
This waiver is governed by the laws of the Province of Ontario and applicable laws of Canada.
I acknowledge that I have sought advice from one or more people that I trust, about this agreement and I fully understand and agree to the content and nature of this agreement.
